MIDJIM TRIBAL GAS SALES TAX
WHEREAS, the Sault Ste. Marie Tribe of Chippewa Indians is a duly recognized
Indian Tribe under the provisions of Indian Reorganization Act of June 15, 1934 (25
U.S.C.A.); and
WHEREAS, the intent of the Tribal Enterprise known as MIDJIM is structured and
managed as a governmental service rather than a for-profit Tribal enterprise; and
WHEREAS, the assessment of a tribal sales tax on MIDJIM sales has a direct impact
of the pricing of goods including, but not limited to, gasoline; and
WHEREAS, the assessment of the tribal gas sales tax on MIDJIM sales inhibits their
ability to be competitive in the local markets which they service.
NOW, THEREFORE, BE IT RESOLVED, the Board of Directors hereby immediately
suspends the issuance of the tribal gas sales tax on MIDJIM stores, for a period of 60
days.
BE IT FURTHER RESOLVED, the Board of Directors hereby directs the Chief
Financial Officer, or his designees, to develop an alternative revenue collection
structure related to the Tribe’s MIDJIM stores.
BE IT FINALLY RESOLVED, that this plan shall be submitted for consideration
and/or approval within 60 days from enactment of this resolution to the Sault Tribe
Board of Directors, if such a plan is not approved, the gas tax shall be instated.

Chippewa Indians, hereby certify that the Board of Directors is composed of 13

RE-ESTABLISHMENT OF GENERAL COUNSEL POSITION
WHEREAS, the Sault Ste. Marie Tribe of Chippewa Indians is a federally recognized Indian
Tribe organized under the Indian Reorganization Act of 1934, 25 U.S.C. 467 et seq; and
WHEREAS, the Sault Ste. Marie Tribe of Chippewa Indians is a nation of citizens with inherent
sovereignty and right to self-governance; and
WHEREAS, Article VII, Section 1(a) of the Constitution of the Sault Ste. Marie Tribe of
Chippewa Indians provides that the Board of Directors shall have the power to employ legal
counsel, subject to the approval of the Secretary of the Interior; and
WHEREAS, the Sault Ste. Marie Tribe of Chippewa Indians has a fully functioning in-house
Legal Department; and
WHEREAS, the mission statement of the Legal Department “is to protect the legal rights and
interests of the Tribe in the administrative, legislative and judicial fora by providing
comprehensive, high quality legal representation and advice to all facets of tribal government and
to its businesses.”
WHEREAS, the Legal Department has traditionally been supervised by an a General Counsel
who has the responsibilities of administering the budget of the Legal Department, overseeing the
legal representation of the Tribe and the Tribal Gaming Authority, enterprises and programs,
representing the Tribal and Tribal Gaming Authority on financing matters, and overseeing the
activities of outside counsel hired by the Tribe; and
WHEREAS, said Legal Department has been operating without a General Counsel for a period of
nearly two years; and
WHEREAS, in order to utilize and benefit from its in-house Legal Department to the maximum
extent and in order for the Legal Department to fulfill its mission statement, it is imperative that
the Tribe re-establish and fill the position of General Counsel.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Directors hereby directs the Human
Resources Department to create and post the position of General Counsel. Funding for this
position shall be derived from the existing Legal Budget.
