Chairman McCoy Manipulates the Referendum Process

Sault Ste. Marie, Mi...If Chairman McCoy throws another roadblock in front of tribal members exercising their constitutional rights, he's going to be fired. He told members that they could have only one packet of petitions and that it had to be stamped with a raised seal.

Come to find out the chairman was wrong. He was pulling a fast one on the membership and breaking the law doing it...if that means anything to him...while limiting the number of petitions available to them for a referendum on whether to go forward with the new Romulus casino...

...otherwise known as the new Greek Deal, or the Greek Giveaway.

The chairman's action has all the earmarks of obstructing the membership's right of referendum. The raised seal prevented them from emailing the petitions to friends and family, relatives and fellow tribal members...to be signed and returned. They would have had to be sent by mail. What's more, he wanted the petitioner to be there when the petition was signed. That too would have prevented the petitioner from using his computer to petition for a referendum.

Section twelve of the constitution is clear about it. There's no mention of either of the chairman's rules. He's guilty of manipulating the process for his own political purposes and the election committee should step up and do something about it.

Well, what about it? The election committee isn't going to lift a hand. Either is the board going to. The chairman has fired lots of members for a lot less. Is he even going to explain his wrongdoing and ask the membership for their understanding and forgiveness. Does he even have any remorse at all for perpetrating this dastardly deed? Should he be fired...?

...you darn right he should. The next time you see him, fire him on the spot.

WHO IS TED GATZAROS?

Greektown businessmen Ted Gatzaros and Jim Papas conspired... with a Maryland businessman to bilk the federal government in a multimillion-dollar loan scheme, a federal prosecutor said in court papers Wednesday.

The government alleges that Gatzaros and Papas defaulted on loans in the early 1990s, then paid a Maryland businessman, William Schainker, to illegally acquire the defaulted loans at a large discount at a federal auction. Man fined in loan scheme with ex-Greektown Casino figures - 2004-12-02... A federal judge has leveled a fine against a Maryland businessman and placed him on two years' probation for defrauding the federal government. This is in connection with loans to former Greektown Casino figures Ted Gatzaros and James Papas.

Aaron Payment Addresses a Fullhouse

Sault Ste. Marie, Mi...Citizen Aaron Payment spoke to a full house at the Pizza Hut here in the Soo last night. A broad cross section of the Sault Tribe membership is alarmed over what has become known as another Greek Giveaway.

The Boushor, Causley, McCoy faction has cooked up yet another scheme to make itself rich..at the individual tribal members expense. They want their Detroit millionaire friend Gatzeros to make off with still another handout...to include the likelihood of there being something in it for them.

Altogether these three directors...along with Rickley and Hollowell... want to giveaway 26% of the gross revenue of the proposed casino in Romulus, Michigan with no Greek money to be invested. Reminding members of the Detroit Greektown disaster...wherein the Greeks made off with a 50% ownership...and a hundred and ninety-five million after investing a mere twenty-five thousand.

The audience at Pizza Hut was eager to hear the message which was expertly delivered by former chairman Payment...that members have until the 8Th of December to get their hands onto a petition and put their signatures on it and get the forms back to him in order for them to have a referendum on whether the tribe should proceed with still another disastrous Greek deal...remember the barge....or stop this one cold in its tracks before it's too late and the tribe gets sold down the creek again...or whether the tribe should seek a much better deal with still some other millionaire eager to strike a deal with it on much more favorable terms... or if the tribe should simply proceed forward on its own and show some backbone and confidence and imagination and build its own casino in Romulus...something on the order of what the Bay Mills Indian Community has done near the Northern Lower Michignan town of Vanderbilt.

EMERGENCY BOARD MEETING....quick

The Board members that conspired to get this casino / developer deal through, should do some damage control and have an emergency Board meeting to revise the agreement to a more acceptable range. Otherwise, the referendum effort will show the Sault Tribe citizens that they really can do something to make change in their government.

There is a danger that the Sault Tribe citizens will gain strength and confidence in their ability to stop the conspiracy.

They could mobilize and become active.

It could lead to other unwelcome participation by the membership.

Why, they might start demanding that their elected representatives start working for the interest of the membership.

They might start telling their representatives what they want from their government

This could get out of hand.

They might even even try to get the "drafted constitution" into law.

This could spell the end of the Bouschor reign.

A word to the wise. reverse the resolution. Ask for membership input. Govern according to the wishes of the membership.

Corruption / Sleaze / Kickbacks

Sault Ste. Marie, Mi...Tribal members have to resent what the wealthy Detroit businessman, Mr. Gatzaros, has done. He's called a member of their tribe and tried to bribe him to use his influence over their board...to get it to vote for a casino in Romulus, Michigan.

Mr. Gatzaros, along with Detroit businessman Mr. Gerald Campbell, also wealthy, made proposals to the Sault Tribe offering their influence with the State of Michigan and the City of Detroit...and Romulus,Michigan...for approval of and the development of a casino in the vicinity of the Detroit Metro Airport.

The tribal board accepted their last offer (on a tie vote broken by Chairman McCoy) for 26% ownership of the new casino in exchange for their influence. With the kicker here being that these wealthy Detroit businessmen aren't putting up any of their own money, not a penny of it. Still on the deal they struck with the tribe, for every $ 100,000,000 the proposed casino grosses they will get $ 26,000,000 of it.

Consider for a moment: the huge difference between 26% of a businesses net profit and 26% of its gross profit...huge is putting it mildly. This deal has a familiar ring to it...remember Greektown? Mr. Garzaros loved that deal. While he put up $25,000.00 of his own money, he made off with $70,000,000, a decent return on any investment. Is there any wonder he's back again...

Mr. Campbell's original proposal to the tribal board was for 28%. One of the board members leaked it out to Mr. Gatzaros and he made a counter proposal of 18%, undercutting the proposal by 10%. Later on and subsequent to one maneuver or the other, each of them ended up with 13% of the proposed casino's gross profits.

So now they're partners in crime. After all, bribery is a felony offense. Certainly the state's Attorney General's Office would see it like that. What about Mr. Ken Ermatinger, one of our very own who sits on the Michigan Gaming Control Board;that board will have a dim view of it, not to mention the F.B.I., who has always had a watchful eye on the gaming world.

Isn't it time to rid the tribe of director Boushor along with his sleazy buddies Mr. Gatzaros and Mr. Campbell. Isn't enough enough when it comes to these three? Think of sleaze in the tribe and who do you think of...yes, two of the above, and now Mr. Campbell the billionaire, making it three.

The tribe really needs to get rid of director Boushor. Get rid of him and the largest part of the sleaze element affecting the tribe will be gone. His latest triumph, successfully manipulating the legal system and getting away with stealing S2,600,000 of the membership's money, straight out of the operating budget, should be the last straw for him.

The director is corrupt. He's become a lightening rod of dissension in the tribe. His simple presence on the board is now a huge deficit for the tribe. He really needs to go...and take his corrupted buddies with him.

This whole affair begs the question...are all the Injuns' on the Sault Tribe's tribal board honest? You be the judge.

For those who may be unclear of the difference between net profit and gross profit the simple explanation is this:
Your paycheck (gross profit) minus your bills (net profit) = the amount you have left to put into savings or spend as you like. Imagine that you made a deal to give your landlord 26%, or more than 1/4 of your paycheck (your gross profit) even if you received lots of overtime pay or earned an extra bonus or commission. Would you give your landlord 1/4 of your extra pay you earned along with your regular rent payment?

Do you give your bank 1/4 of any extra pay you receive for your mortgage payment just because you like them so much? Kind of stupid isn't it?! What kind of stupid board members and tribal chairman would agree to such B.S.? Dumber than a box of rocks stupid ones...that's who with Bernard Bouschor at the top of the pile!

This is an important referendum. The only ones who made any real money off Greektown were the Greeks and Bouchour. Let's not let it happen again. Be sure to get you name on this referendum and put a stop to it before it's too late. They want another big financial deal in Detroit in the hopes of reaping another big payoff for themselves. Neither of them have any money of their own in this deal. The same as it was with Greektown, they have nothing to lose and everything to gain...just from consumating the transaction itself. The casino can fail and they will still make out...as they did with Greektown. The only ones with something to lose are you, the individual tribal member. Because it's your money they want to invest.

Please say no to them...

Bouschor Repeats "One last Lie"

Bouschor secretly crafted a plan to pay off his political promise.
He did not communicate, with the governing body, his plan to fire "key" legal department and administrative employees.
He did not communicate to the Board of Directors that 2.66 million dollars would be
withdrawn from tribal accounts in such a stealth like manner and without their approval.
Bouschor assumed that Mr Payment would fire his political henchmen, yet, no one was
ever fired during the Payment term.
Bouschor said that he "acted in the best interest of the tribe"....HOW?
Bouschor had created an "us against Payment" mentality with his "key employees".
They didn't want to work under Chairman Payment because they would then have to be accountable.
Through political maneuvering, Bouschor managed to delay justice.
He has managed to keep the Sault Tribe citizens from enjoying equal protection under the law.
The entire Bouschor era was given a free pass by the Board of Directors, especially the long term members.

The High Road...Not Yet

Cathy Hollowell is sick and tired of hearing from those, people that elected her, that want justice.
She is the enlightened one, after all, and wants to suggest taking a higher road.
She knows that this hatred toward Bouschor and all of the others that supported or took part in the theft of tribal resources has been festering for two decades.
She is aware of the criminal behavior, abuse of power, mismanagement and blatant greed that has been the backbone of the Bouschor era, as well.
She understands that there has never been any protections for the membership against such behavior and it has cause great harm, yet, she wants the citizens to just wipe it out of their minds.
She suggest that everyone just move on.

The tribe has no statute of limitations, so is there cause for removal of Bernard Bouschor for exceeding the legal limits of campaign spending as well as his efforts to conceal the overspending? See File

Character Reference for Fred Paquin

Would anyone like to send a rebuttal to the judge regarding the attached character reference for Fred Paquin? James Bishop considers Fred Paquin who embezzled thousands from the members of the Sault Tribe to be a "vital pillar.." in the St. Ignace community.

Doesn't Mr. Bishop realize that the generosity of Paquin was at least partially funded by his embezzling activities? If you steal and give a portion of it away does that make it right?

Not only did he steal from us but many complained that he threatened and harassed those who were aware of many of his indiscretions. The address to the judge is provided in the link. Please take the time to send the judge a short note of your own. Let's put at least one crook in prison where he belongs.

Upper Peninsula Democrat Dick Timmer wants a plan for Michigan

This is what Dick Timmer had to say in an interview with the Petoskey News.

Timmer, a Brimley resident, recalls his younger years during the Cold War when Americans worked toward a "common cause.

"We had a goal," he said. "It was to beat (Russia) in space. It was to beat them in armament. Now, we seem to have no direction, certainly not in our schools or state and local government."

"I think the biggest thing experience has taught me, is that the state of Michigan needs a big-picture plan," Timmer said. "Coming from the construction industry, I work with project developers as a consultant and we need a plan that looks down the road five to 10 years. Without that plan, we can't make intelligent decisions, because all the decisions are being based on this budget year or hot-button items effecting the populous."

In regards to the Michigan Business Tax,"Personally, I think it is a mess," Timmer said. "But with our revenue stream and funding so tight, I don't think we can just throw it out and say it is going to create more jobs."

Modification, Timmer said, would keep the revenue "about the same" without "jeopardizing education, mental health, roads or the other (departments)."

"It's a bad law," Timmer said. "As a small businessman, I get frustrated. It makes you not want to go to the next level of development and growth."

But, at this point, Timmer said he "disliked" the idea of just "throwing it out."

"The reality is we need that revenue until we can find another way to fund government," he added.

Sault Ste. Marie, Mi...A careful review of Mr. Bernard Bouschor's instructions to the tribe's law firm in 2004, Miller-Canfield...reveals that he instructed them to confirm for him that he could fire the tribe's key employees and pay off their employment contracts. Mr. Horton, the tribe's lead attorney in the civil trial, Sault Tribe vs. Bernard Bouschor, of Giamarco, Mullins, and Horton, made specific note of that fact before the jury...that former Chairman Bernard Bouschor didn't ask whether or not he could fire the key employees and pay them off, he instructed Miller-Canfield to confirm for him that he could.

This is important to note because in 2004 Mr. Bouschor was used to giving these same instructions to the tribe's legal department. Whenever he wanted something of the tribe's board of directors, he was able through using this tactic to browbeat the board of directors into cooperation and he was able subsequently to keep the board and the tribal membership under his thumb. The big complaint of that time period was how the board rubberstamped everything that Mr. Bouschor wanted. This was also the reason why it was important to rid the Sault Tribe of Mr. Bouschor and his close associates in the legal department (most of whom had worked with him for twenty years or more), because they confirmed for him anything he instructed them to in order to keep their employee contracts and their high paying jobs.

The court records now reflect that Mr. Bernard Bouschor had this same kind of a relationship with the tribe's law firm in 2004, Miller-Canfield. He instructed them to confirm for him that he could fire the key employees and payoff their employment contracts, and he asked them to prepare whatever paperwork was necessary to complete that task, as well as whatever paperwork was necessary to rehire them if he won the election and to keep them on for a period of up to two years, with the option of amending the provision to enable him to keep them even longer.

Mr. Horton also substantiated for the court that the former chairman's relationship with Miller-Canfield was close as it was with the tribe's legal department, when he revealed to it that Miller-Canfield had rewarded Mr. Bernard Bouschor with $1,000.00 in twenty and fifty dollar bills for sending the $28,000.00 of tribal work their way, purportedly to be used in his ongoing reelection campaign...

Jim Smith/Durty Dayz

Who is Jim Smith? 'Jim' has left a slew of comments on the numerous articles related to Bouschor and the lawsuit. 'Jim' writes that according to all the negative comments that my views aren't as popular as I think they are. Funny thing is, almost all of the negative comments are being written by JimSmith/DurtyDayz and they are coming from the Sault Tribe of Chippewa Indians server.

'Jim' seems to have a lot of time on 'his' hands at work since 'he' has been on my blog 22 times so far today. "Jim' is a regular daily visitor but claims that this site is worthless. Typical of 'JimSmith':hypocritical, a cheater, and a liar. Stop wasting tribal money and get your rear end to work!

Bouschor's Win Demonstrates how "worthless" the Sault Tribe Constitution is.
It doesn't offer any protections from corrupt behavior. Race did not have a play in this decision. The failed tribal constitution was the culprit and always has been.

This event should be the engine that mobilizes the membership to secure the already drafted constitution that offers real protections against corruption.

Now, in the court of his peers, Bouschor can be judged.

The current constitution doesn't protect the people but they have other actions that they can use to remedy the problem. Charges can be filed, recall petition can be used. We can achieve his removal as well as others that show this kind of behavior.

Let's not let this disappointing decision break our will to restore the integrity of our government. We must collectively fight for a day when our leaders will think twice before they steal from us.

A Few Thoughts About the Trial and Other things ...

ault Ste. Marie, Mi...A few thoughts about the trial...and other things.

1. It's amazing how people can turn right around and do to somebody else what they've just accused another person of doing...

...the second defense lawyer who spoke during closing arguments spent all his time attacking Mr. Aaron Payment and blaming him for all of the upheaval from 2002 through 2004. He called Mr. Payment all kinds of names and made all kinds of derogatory remarks about him and gave him all the credit for those turbulent years...blaming him for the cloud of mistrust and conspiracy which hung over the tribe then and for all the years since then.

Then moving on from Mr. Payment, he began to attack that big law firm of Horton, Miller and Canfield, saying how big it is and how Mr. Horton was using all of its legal prowess to beat up on and take advantage of the ordinary citizens...who had dedicated their life's to developing and building the tribe up to what it is today...

2. It's surprising to hear flaring rhetoric in a civil case in a courtroom. People just assume that trials in those somber sittings will be settled with reason and rational explanations...for what the defendants did or didn't do. . But when the case is over and you realize that it wasn't decided on the facts, but on the rhetoric of the lawyers and their emotional reasoning and the continual repetition of the views that they wanted the jurors to remember and the defendants crying over a job that they loss six years ago...then hey, it 's more than disappointing to anybody and it's downright disillusioning and it makes people lose faith in the system and think about throwing in the towel and letting the liars and criers win.

3. A tribal lawyer was asked why he didn't mention the elders while prosecuting the case and discuss how they had loss out on medications for themselves and health coverage for their nonnative spouses which was often the only health care coverage that they had access to. And he replied that he wasn't able to link it directly to the money that the defendants stole from the operating budget and therefore he wasn't able to enter it into the case...money in the operating budget comes out of casino revenue. So director Bouchour and the key employee knew what they were doing.

4. So the monies gone, they got away with it, we should be used to it by now, the big guys get away with stealing. Now it's six years behind us and for the most part its impact on the tribal citizens is over with. We really don't have any skin in the game anymore where it's concerned. So let them have it. They seem to be desperate for it. We're alright without it.

Where we won't be alright though, is in our loss of faith in the system and in our tribal leadership. Those people were elected to represent us but they're not doing it, they don't seem to have the courage to do it, they're more interested in fitting in with their cohorts and being a part of tribal government than taking a hard stand on the important issues that are causing so much dissension in the tribe.

Rather than taking responsibility for all of the dissension, our leaders our blaming it on the citizens themselves or certain bad types of citizens. They refuse them a vote on the new constitution after promising them they will have one and now they have a tribal government that isn't working. That's floundering. That's without effective leadership...and despite being told over and again that we need a three branch government...our leaders don't have the will or the courage to act on it and do the right thing...and conduct a vote on the new constitution.

TRIBAL MEMBERS BURNING UP THE INTERNET TONIGHT

Between Facebook, this blog and emails, it is very apparent that the Sault Tribe has been let down by the non-native jury. We have given so much to Sault Ste. Marie only to be slapped in the face in return when the jury saved the rich boys and let the rest of us sink.

On the bright side, this has been a great motivator. If we had won, we might have cheered and waited for another six years to get the first dollar back.

We didn't win. Instead, we have thousands of Sault Tribe members in an uproar. Plans to circulate petitions to remove Bouschor, Pine and also McCoy have been echoing across the internet and phone lines. The idea to parade down Ashmun Street in protest is being tossed around.

I think we need a date and a meeting place set ASAP. Any suggestions to get the ball rolling are welcome. We don't need the Bouschor family tribal courts or the Sault courts to determine our fate. We are sovereign and we determine how our tribe is run and who oversees our judicial system. We decide what our constitution says...not the criminals it protects now.

No more separation between tribal members...it's us against them.

Tribal Citizens / Shortchanged Again

Sault Ste. Marie, Mi...Most people are naive when it comes to racism. But to think that an all white jury would agree with the defenses argument, that the six white defendants were in essence drummed out of their jobs and, in the final assessment out of their community, by continual email and media attacks during a political campaign and that their long time political buddy and crony, director Bouchour, would be exonerated for his role in trying to help them escape with a big payday...is almost beyond comprehension.

However, we saw what happened in the O.J. Simpson trial and it should never be forgotten as a good example of the role that racism and money can play in a high profile trial.

Consider this: the defense said the defendants were called white pigs and white man while in the performance of their duties and told to go and leave Indian land, etc., etc., etc...putting them under great stress and unable to properly perform their duties.

Also consider this: the defense had one trial underway but with three separate attorneys representing separate clients and they spent a great deal more time presenting their case because of sheer numbers whereas the tribe had only one trial underway but only with two attorneys representing one client and time alotted for only one of them to present its case...as was demonstrated in the closing argument, the defenses had three times and much time before the jurors as the tribe.

This resulted in a jury that was swamped with huge piles of exhibits and three times as much presentation from the defendants side of the case than what was being presented from the plaintiffs side. This was particularly apparent on the last day of the trial. The tribe's attorney spent one hour presenting his closing arguments whereas the defenses three attorneys spent in the neighborhood of three hours or more, with each one of them focusing on a different aspect of their closing arguments.

The tribal citizens have been shortchanged again.

Anyone who knew what was happening in that trial would know that the defense was primarily based on all the racist memo's, emails and campaign ads that Aaron flooded those people with. Now if he had ran a campaign on the issues, and pointed out the flaws in those people instead of focusing on cheap racist tactics, maybe the tribe would have won, as they deserved to ! I spoke just moments earlier to a director on the Sault Tribe board about the outcome of the trial but was told to wait a little while since ONLY the board members knew of the outcome that they were just informed of.

Now surprise, surprise...one board member was delighted to let me know how he or she felt about the outcome and since the focus is on blaming Aaron Payment my guess is that 'Anonymous' can only be one person.

Which board member has shown nothing but sarcasm towards those tribal members who speak about the corruption in this tribe?

Which board member has supported Bouschor throughout this ordeal?

Which board member tried to deliver documents in support of Bouschor to the board during a meeting which were confiscated by the tribe's legal department?

Anyone want to bet Anonymous is Deb Pine? To act as though the loss to the tribe is of any consequence to her is a complete ruse. Her mother, Jolene Nertoli, benefited from the ripoff. The Trial is Over / Sault Tribe vs. Bernard Bouchour

Sault Ste. Marie, Mi...Well the trial is over. The jury was sent to the jury room at 2:00 p.m. to discuss the case and to reach a verdict. It may come in as little as an hour or it may be as far off as a week or so. The jury will remain sequestered until five of the six jurors agree on a verdict or until the judge in the case declares it a mistrial. Mr. Horton, the tribe's lead attorney, has agreed to call with news of the verdict as soon as the jurors return to the courtroom and at that point it will be forwarded to you.

The Plaintiff Has Rested Its Case / A Verdict as Early as Tomorrow

A big thanks to Charles Forgrave for keeping me updated with news of the Bouschor 7+2 trial.

According to some reports, Dave Scott, one of the recipients, resorted to tears on more than one occasion in an attempt to convince the jury that he was a victim and deserved a portion of the secret payoffs.

Earlier reports from Mr. Forgrave state that the attorneys for the defense carried on a well-orchestrated defense on the first day of the trial but their strategy soon fell apart as the trial progressed.

The defendants also claimed that Aaron Payment ruined their reputations with his campaign for the chairman's seat. My recollection of that campaign is quite different since I remember numerous slanderous materials received not from Payment but from his opponent, Bernard Bouschor.

The following report has been corrected. It was reported that the defendant had rested its case when it was actually the Sault Tribe who had done so.


Sault Ste. Marie, Mi...Well, the Sault Tribe as Plaintiff has rested its case. No more witnesses will be called to testify. During the course of the trial the defense called two witnesses to the stand and the tribe called seven. The jury was dismissed today at noon and ordered to reconvene tomorrow at 8:30 a.m.to view the submission of several exhibits and to hear closing arguments...which are expected to take on the order of an hour or two.

Subsequent to dismissing the jurors, the court was called back into session. The defense immediately made six motions all of which were rejected by the judge...a couple of them were for directed verdicts (wherein the judge rules on the case and settles it) and several were for the admission of additional evidence.

So tomorrow morning the case goes to the jurors and it will be up to them...guilty or innocent. All said and done, members may know one way or another as soon as tomorrow. Or it may take several days for them to decide the case. There really no way of knowing at this point how the case will be decided. We all can only wait.

SAULT TRIBE EMBEZZLER RECEIVES AWARD

Fred Paquin, former Sault Tribe police chief, who will be sentenced soon for embezzling from the Sault Tribe is being rewarded nicely for his donations. A report several months ago stated that Paquin had used tribal funds to purchase goods, some of which he later donated in his name.

Our tribal dollars (purchased with his double dipping salary and embezzlement monies?) are at work at the Fred Paquin owned Gateway Lanes. How ironic that this scum of the earth who stole from tribal members is such a welcome figure to some organizations in St. Ignace, Michigan. At one point, one supporter pushed for Paquin to be hired as police chief and he serves on the hospital board in that town.

Talk about a slap in the face to the citizens of the Sault Tribe that he stole from.

Director Malloy, in her Board Note, has exposed either the inept, incompetent, corrupt, complicit or negligent character of the Sault Tribe Board of Directors.

Do they understand their responsibility to see that the laws are enforced ?

If the answer is "no" to either one.....then they are inept, incompetent and negligent.

The smirk on Bouschor's face is telling of his contempt for Sault Tribe members. It is also the only way that he can hold back the laughter.

The membership has not only been bluffed but they have been hornswoggled, as well.

First, a thank you to DJ Malloy, Unit One Director, is in order. In the latest edition of the Sault Tribe News she addressed the biggest question pending among citizens of the Sault Tribe. Malloy did the research that could support a plan of action not only against Bernard Bouschor's seat on the board but also against those who contributed to the vote of the members being overturned that resulted in Bouschor's 're-election'.

In the article above, Rick Janetos makes several good points related to Director Malloy's findings. Maybe our tribe is moving forward after all. We have made many leaps and bounds with the arrest of Fred Paquin who may be assisting in the removal of the worst of the Sault Tribe. If we stand tall and don't give up, the light at the end of the tunnel may finally burn brightly once again.

Horse Race Track Says Wayne County “Perfectly Comfortable” With Controversial Land Deal

Wayne County was aware of a horse racing track's plans to sell some of the 240 acres of land it bought from the county for $1, according to Carl Herstein, an attorney representing Post It Stables, the corporation that owns Pinnacle Race Course.

The Huron Township race course became the subject of an internal investigation by the county after it was learned that Post It Stables sold seven acres of the land to the Sault Ste. Marie Tribe of Chippewa Indians for $179,000. The seven acres was part of 240 acres bought from Wayne County for $1.

Carl Herstein, a partner in the Honigman, Miller, Schwartz and Cohn law firm, said county officials were "perfectly comfortable" with the track selling the $1 land because it was part of a bigger plan to attract development to the region.

When asked if the county approved of the land being sold to an Indian tribe, which would remove it from the county tax rolls, Herstein said, "You'd have to ask them."

Wayne County Deputy Chief Executive Azzam Elder said in an e-mail that he was out of town last week and would look into the matter when he returned. Wayne County Administrator Robert Ficano didn't respond to an e-mail seeking comment.

Herstein said the track ownership is considering the sale of five more parcels, although he didn't know how large the parcels would be.

Documents from the Michigan Economic Development Corporation talk about the horse racing as part of a redevelopment of the racing area.

Herstein said Post It Stables, owner of the race track, has spent a lot of money on infrastructure improvements on the property, such as more than $1 million spent on drain improvements.

Wayne County Commissioner Ed Boike has called for an internal investigation of Wayne County's dealings with Post It Stables.
At which point did anyone from the tribe become involved? Did the Chairman, any member of the Board of Directors, or anyone with the authority to make decisions to work or seal deals such as this one partake in any arrangements prior to the land sale of $1 to Post It Stables?

Why is the law firm of Honigman, Miller, Schwartz and Cohn making statements in regards to actions of the Sault Tribe? Shouldn't the chairman be knowledgeable enough to speak for us? How much has the tribe paid this lawfirm to date? It has been reported that they have received between $55 and $77 million just over the last few years.

Just a few years ago these same board members and several of the tribal crazies were making a huge deal over what was being paid to one of our own tribal members who served as general counsel so why aren't they screaming their heads off over what we are paying this lawfirm? If you hire a lawfirm wouldn't you expect it to look out for your interests. What did we get for that amount of money besides more debt?

Something doesn't smell right about this whole deal. What do you think?
